[1]The Claimant was an employee of the Respondent;[2]The Respondent made an unauthorised deduction from wages by failing to pay the Claimant in lieu of accrued but untaken annual leave on termination of the employment and is ordered to pay the Claimant the sum of £651.78, being the gross sum due. This has been calculated as follows: The Claimant worked an average of 38.5 hours per week at a rate of £8.91 per hour 38.5 x £8.91 = £343.04 5.6 weeks holiday, divided by 1/3 as the Claimant worked 1/3 of the holiday year = 1.9 1.9 x £343.04 = £651.78[3]The Respondent is ordered to pay to the claimant additional compensation of £686.08 pursuant to section 38 Employment Act 2002 for failure to provide the Claimant with a written statement of employment particulars.
