The complaint of unfair dismissal is struck out.REASONS
[1]By a letter dated 20 October 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out because the claimant was not employed by the respondent for two years or more. He responded by email of 31 October 2021.[2]The claimant says he has not been dismissed. Even if he was, the Tribunal has no jurisdiction to hear a claim of unfair dismissal if the employee has less than 2 years’ service. There are exceptions where dismissal is for one of a limited number of automatically unfair reasons.
