JUDGMENT

(1) It was not reasonably practicable for the claimant to submit her claim in time, but the claim was not submitted within a reasonable period thereafter. The claim was therefore presented out of time, and the tribunal does not have jurisdiction to deal with it (s.111 Employment Rights Act 1996).

(2) The claimant does not have two years’ service and therefore, for that reason too, the tribunal does not have jurisdiction to hear the unfair dismissal claim (ss.210 and 212 Employment Rights Act 1996).
