JUDGMENT

[1]The Claimant was not an employee. The complaint of unfair dismissal is therefore struck out because the tribunal has no jurisdiction to hear it.[2]The Claimant was a worker within the meaning of 230 (3) of the Employment Rights Act 1996[3]The Claimant’s application to amend to add a complaint of being subjected to a detriment under regulations 2 (2) and (3) of the Exclusivity Terms in Zero Hours Contracts (Redress) Regulations 2015 is refused because it has no reasonable prospect of success.[4]The claim is therefore dismissed
