JUDGMENT

The claimant’s complaints of unfair dismissal, age discrimination, notice pay and holiday pay are dismissed upon his failure to attend or be represented at today’s preliminary hearing, pursuant to Rule 47.

REASONS

The claimant presented various complaints (but did not complete all of the claim form details) on 24 September 2019. No response was received. A preliminary hearing was arranged. In October the claimant applied for an interpreter for today’s hearing and that was arranged. I have had to discharge the interpreter today no doubt at public expense. The claimant did not attend nor make any contact with the Tribunal, (his last contact on the file is an email on 14 October). My clerk has tried to contact him by email and by telephone (but the latter is an overseas number and the system would not permit connection). Something untoward may have happened to prevent the claimant’s attendance and I have considered an unless order mandating an explanation, but that involves further delay and administrative and judicial time and expense. I have, in any event, concluded the likely position is that the claimant does not pursue his claim and does not wish to attend. In those circumstances I exercise my discretion to dismiss the claim pursuant to Rule 47. Dated: 14 November 2019
