JUDGMENT
[1]The Respondent has made an unlawful deduction from the Claimant’s wages and shall pay to him the sum of £3,053.47 being the gross amount of the unlawful deduction.[2]The Respondent is in breach of contract as it has failed to pay to the Claimant the sum of £251.28 being expenses contractually due to him.[3]The amounts at paragraphs 1 and 2 shall be paid no later than 14 days from the date set out below.[4]The claim for a protective award brought by the Claimant in these proceedings is dismissed as the Claimant has no standing to pursue the claim. (For the avoidance of doubt the Claimant is entitled to benefit from the Judgment making a protective award dated 19 June 2019 in the case of UNITE the Union v Davymarkham Limited (in administration) brought with case number 1805671/2018).
