JUDGMENT

[1]The claim form presented on 23 September 2019 does not comply with Rule 3(1)(c) of the Employment Tribunals (Early Conciliation: Exemptions and Rules of Procedure) Regulations 2014.[2]The decision to accept the claim on 27 September 2019 is hereby revoked because the Claimant has not shown the exemption relied upon (that the Respondent contacted ACAS in relation to this dispute). The Claimant confirmed that he had misunderstood the position when he completed the claim form and was not exempt from the early conciliation requirements at the time the claim was presented. The claim is rejected because it was/is substantively defective.
