JUDGMENT

[1]The complaint of direct discrimination contrary to the provisions of section 13 of the Equality Act 2010 (“EQA10”) was not presented in time but it is just and equitable to extend time.[2]The complaint of discrimination arising from disability contrary to section 15 of the EQA10 was not presented in time but it is just and equitable to extend time.[3]The complaint of a failure to make reasonable adjustments contrary to the provisions of sections 20 and 21 of the EQA10 was not presented in time. It is just and equitable to extend time, limited to the year end award but not just and equitable to extend time as to the adjustment of the trigger points within the Respondent’s management of attendance policy.
