The claims against the First and Second Respondents are dismissed following a withdrawal of those claims by the Claimant. The claim was served on its registered office. The Claimant took steps to ensure that it came to the attention of Ms C Smith, Director. I am satisfied that it is appropriate to issue judgment under Rule 21.[2]The Claimant’s complaint under Regulation 15 of the Transfer of Undertakings (Protection of Employment) Regulations 2006 of failure to inform and consult her is well-founded and succeeds.[3]Having regard to the seriousness of the Respondent’s failure it is just and equitable to order the payment of the maximum sum. The Respondent shall therefore pay the Claimant £3453.45, being thirteen weeks’ pay.
