REASONS
[1]The claimants in 1804580/2025 and others having received confirmation from the administrators of the respondent that: 1.1. There were 20 or more employees employed at one establishment within the 90 days leading up to the insolvency; 1.2. Less than 30 days consultation of the redundancies was given; 1.3. The administrator was not aware of any recognised trade union; 1.4. The administrators do not wish to contest the protective award claim; and 1.5. There are no mitigating factors which would reduce a protective award from 90 days; and[2]Having taken account of the ET3 response provided by the Secretary of State;[3]In my judgment it is in accordance with the Overriding Objective to issue a Rule 22 Judgment upholding the claimant and making the award sought by the claimants.
