JUDGMENT

[1]The correct title of the respondent is Beaumont Care Limited trading as Caremark Calderdale.[2]In the absence of the claimant all claims are hereby dismissed.

REASONS

[1]The case was listed for 2.00pm.[2]At that time the claimant did not appear.[3]I instructed the clerk to telephone the claimant.[4]The clerk telephoned the claimant and reported to the Tribunal that the claimant did not pick up the telephone and the clerk left a message that the claimant was supposed to be at this hearing.[5]I waited until 2.15pm for the claimant to arrive. The claimant did not arrive. Case No: 1804462/2022[6]The respondent pointed out that in the claim form the respondent had stated at paragraph 1.11 that she would not be able to take part in a hearing by video.[7]The clerk advised that notwithstanding the answer it was practice to proceed with a CVP leaving the onus on a party to contact the Tribunal if the party did not wish to proceed by way of CVP.[8]It was very clear from the notice of hearing that this was to be a CVP hearing and the clerk advised that there was no application by the claimant for a hearing other than by CVP.[9]In all the circumstances I decided to dismiss all claims.
