JUDGMENT

Upon the first respondent not submitting a response and the second respondent making representations in writing:[1]The complaints that the Respondent failed to comply with the requirements of Section 188A of the Trade Union and Labour Relations (Consolidation) Act 1992 are well founded and succeed.[2]I make a protective award in respect of all the Claimants in the attached schedule in respect of such failures by the Respondent.[3]All other claims are dismissed upon withdrawal.[4]In respect of each and all of the protective awards the protected period is 90 days and begins on 30 March 2025.[5]The recoupment regulations apply. The effect of which is set out in the Annex to this Judgment.
