JUDGMENT
[1]In so far as there were complaints of unfair dismissal and disability discrimination in this claim those complaints are dismissed.[2]For the avoidance of doubt the claim is proceeding in respect of holiday pay and alleged unauthorised deduction from wages.REASONS
[1]In fact the claim form could not be understood as bringing an unfair dismissal complaint. The claimant acknowledged at that time that he did not have sufficient length of service.[2]It also did not really seem likely that the claimant was bringing a disability discrimination complaint either. However following lengthy discussion about that Case No: 1804450/2019 matter at a case management hearing of today’s date the claimant indicated that he was not proceeding with such a complaint.[1]The Claimant’s complaint of unlawful deduction of wages is not well founded and is dismissed.[2]The Claimant’s complaint of non-payment of holiday pay is well founded and the Respondent is ordered to pay the Claimant the sum of £422.26.
