Employment Tribunals Rules of Procedure 2013 – Rule 21 The response having been rejected because it was presented out of time and no application having been made pursuant to rule 20 to extend time, notwithstanding the information sent to the respondent accompanying the letter from the Tribunal dated 23 October 2019, the following judgment is entered:[1]The respondent unfairly dismissed the claimant.[2]The respondent shall pay to the claimant compensation in respect of the unfair dismissal in the sum of £9,740, comprising a basic award of £1,440 and a compensatory award of £8,300. The basic award is calculated by reference a multipier of 3 because the claimant was over the age of 41 and he worked for two continuous years. His weekly pay was £480. The compensatory award constitutes a sum of for losses of earnings of £5,420, losses of statuory rights of £960 and four weeks’ pay for a failure to provide written particulars of employment of ££1,920.[3]The hearing listed on 6 December 2019 is cancelled.
