Case No 1804293/2022
Mr G BlackburnClaimant1. CSG FM Limited t/a Lita Group (in administration) 2. Secretary of State for Business, Energy and Industrial StrategyRespondent
Employment Judge Cox DateDate 28 November 2023

JUDGMENT

The claim is struck out.

REASONS

[1]The Claimant failed to attend the Hearing of his claim on 28 September 2023. He was ordered to confirm whether he wanted to continue with his claim and to provide further information about it. He was warned that if he did not respond, the Tribunal might consider striking out his claim because he had failed to pursue it and/or because he had not complied with the Tribunal’s Orders.[2]The Claimant did not comply with these Orders.[3]By a letter dated 14 November 2023 the Tribunal gave the Claimant an opportunity to make representations, or to request a Hearing at which he could make them, as to why his claim should not be struck out because he had not complied with the Orders of 29 September 2023 or because the claim has not been actively pursued.[4]The Claimant did not respond to that warning.[5]The claim is therefore struck out because it has not been actively pursued and the Claimant has failed to comply with the Tribunal’s Orders.
