JUDGMENT
[1]The correct Respondent is confirmed as Mr Robert Brett, and the misdescription on the tribunal paperwork naming “The Main Fish and Chip Company” is corrected.[2]The Respondent has not made any unauthorised deduction from the Claimant’s last week’s wages up to 3rd April 2021, expected to be paid on 7th April 2021, because this is a reconciliation, reflected in the figure in final monthly pay statement on 15th April 2021, to reimburse the employer for an overpayment of wages over the previous 19 weeks of employment.[3]The Claimant had accrued 10.74 days holiday from the commencement of employment up to the date of termination, but had taken 11 days leave, so that there is no entitlement to any further payment for untaken holidays.[4]The claims are therefore dismissed, with no order as to costs/preparation time.
