Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the Leeds Employment Tribunals on 24 May 2024. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The claim of unfair dismissal and a failure to provide a written statement of employment particulars succeeds and the remedy to which the claimant is entitled will be determined at a Remedy Hearing.[3]The hearing listed on 21 November 2024 will be converted to a remedy hearing and reduced to 2 hours. The Remedies Judgment of the Tribunal is set out below:[1]The claimant is awarded £54,196.57 in relation to his complaint of unfair dismissal.[2]The claimant is awarded £1400 (i.e. two weeks’ capped pay) in relation to his complaint that the respondent failed to provide him with a written statement of employment particulars.[3]The total award payable to the claimant is therefore £55,596.57.
