Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim for a redundancy payment succeeds.[2]The Respondent is ordered to pay the Claimant a redundancy payment of £,2,200.50.[3]The claim for damage for failure to give notice of termination of employment succeeds.[4]The Respondent is ordered to pay the Claimant damages of £1,277.31 (calculated net of income tax and National Insurance contributions).[5]The claim of failure to pay accrued holiday pay due on termination of employment succeeds.[6]The Respondent is ordered to pay the Claimant £2,145.60 (calculated gross) in respect of that entitlement.[7]The complaint of unauthorised deduction from wages in respect of the Claimant’s final month’s salary succeeds. The Respondent is ordered to pay to the Claimant the amount so deducted being £1,478,32 (calculated net of income tax and National Insurance contributions and a payment of £366.68 by the Respondent).[8]The complaint of unauthorised deduction from wages in respect of pension contributions succeeds.[9]The Respondent is ordered to pay the Claimant £132.60 in respect of that deduction.[10]The Hearing due to take place on 14 May 2018 is cancelled.
