The claimant’s application dated 31 August 2021 to reconsider rejection of the claim against CGTR Realisations Limited is granted. The claim against CGTR Realisations Limited shall be treated as accepted on 31 August 2021, with permission to amend to identify the claim as set out below.REASONS
In accordance with Rule 13(4) the original rejection was correct. The claim details made no reference to a Section 192 TULR(C) A claim, but only to non payment by the Secretary of State (a section 188 Employment Rights Act 1996 claim). The Claimants’ solicitor clarified on 31 August 2021 that the claimants intended to pursue a Section 192 claim for non payment against the second respondent. It is in the interests of justice to permit that as an amendment to the claim for the reasons set out in the reconsideration application (there may be assets in the administration). That is all the more so when there has been no opposition from the administrator by today (13 September 2021), the claimants’ solicitor having represented that the claimants’ application was copied to the administrator.
