The claim is struck out.REASONS
[1]The Claimant complains of unfair dismissal.[2]Section 108 of the Employment Rights Act 1996 requires a Claimant to have not less than two years’ service to make that complaint.[3]At a Preliminary Hearing on 22 November 2021 the Claimant accepted that he had not been employed by the Respondent for two years or more. On 23 November 2021 the Tribunal wrote to him to warn that it was proposing to strike out his claim because it had no reasonable prospect of success for that reason. It gave the Claimant until 7 December 2021 to make any objections to that proposal in writing or request a Hearing at which he could make them. He did not respond to that warning.[5]The claim is therefore struck out.
