The claim against the Second Respondent is struck out.REASONS
[1]The Tribunal wrote to the claimant on 5 August 2025 warning him that the Tribunal was considering striking out the claim against the Second Respondent. This was because it appeared to the Tribunal, applying Rule 38 of the Employment Tribunal Procedure Rules 2024, that the claim against the Second Respondent had no reasonable prospects of success, as the claimant was not employed by the Second Respondent.[2]The letter gave the claimant an opportunity to explain why the claim should not be struck out. On 6 August 2025 the claimant’s representative informed the Tribunal that the claimant does not object to the claim against the Second Respondent being struck out.[3]The claim is therefore struck out.[4]The hearing on 22 and 23 December 2025 will remain listed against the First Respondent.
