JUDGMENT

The response is struck out.

REASONS

[1]By a letter dated 02 March 2021 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out.[2]This is the second Preliminary Hearing the Respondent has failed to attend. The reason given for non-attendance is wholly unsatisfactory and shows no regard for the priority which ought to be given to court proceedings. This was a telephone hearing. The respondent did not even take steps to notify the Tribunal that he could not attend. The response is therefore struck out.[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £1800.00.[2]The hearing listed on 12 May 2021 remains as listed pending the claimant’s response to a strike out warning in respect of his claim of unfair dismissal.
