JUDGMENT

The claim for a redundancy payment is struck out.

REASONS

[1]By a letter dated 05 August 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of failure to pay a redundancy payment should not be struck out because it  it has no reasonable prospect of success, given that the claimant had already received a judgment for a redundancy payment covering the same period with a different employer.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint is therefore struck out.[3]The claimant’s remaining claim for unfair dismissal remains listed for hearing on 25 November 2021 but is also now made subject to a strike out warning.[1]By a letter dated 9 September 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the remaining claim of unfair dismissal should not be struck out because it has no reasonable prospect of success.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 25 November 2021 will not take place.
