JUDGMENT
[1]The title of the Respondent is amended to describe it as Multiclean Supplies Ltd.[2]The Claimant has established that he was entitled to unpaid wages in the sum of £1,785.00, unpaid notice pay in the sum of £255.00, and unpaid holiday pay in the sum of £274.61. and therefore he is awarded and shall be paid by the Respondents the total sum of £2,314.61REASONS
[2]The Claimant gave oral evidence of what pay he was due to receive during employment but was not paid at all, of not being paid holiday accrued and due during his employment, and of having been given but not being required or expected to work 2 weeks of notice.[3]The Respondent has not filed a Response (ET3) to this claim nor contested these proceedings and didn’t attend today to give formal sworn testimony. Accordingly, the Claimant’s version of events was preferred.[4]I could not take account of any representation of the Respondent as there were none, nor was there an ET3 Response to the claims, and thus on the basis of seeing and hearing the Claimant and not being able to test the Case No:1803742/2019 Respondent’s case under examination, I preferred the evidence of the Claimant in all respects.[5]The Respondent has failed to establish any basis or grounds for nonpayment of the sums found to be due to the Claimant and in particular no formal written agreement signed by the Claimant permitting withholding of pay for the wages and holiday pay due for the periods claimed by the Claimant.[6]Thus the Claimant is entitled to be paid by the Respondent the following: - Item £ Unpaid wages 1,785.00 Holiday Pay 274.61 Notice pay 255.00 Total 2,314.61 I award Judgment and order that the Respondent shall pay to the Claimant the sum of £2,314.61
