ON APPLICATION FOR INTERIM RELIEF The application for interim relief is refused.REASONS
[1]The claimant presented a claim to the Employment Tribunal on 15 July 2021. Within that claim she had indicated that her claim consisted of a complaint of unfair dismissal which contained an application for interim relief.[2]The notice of claim was sent to the respondent who has until 24 August 2021 to provide a response. A notice of application for interim relief was sent to the respondent on 27 July 2021. The parties were also sent a notice of hearing on 27 July 2021 which indicated that the claimant had applied for interim relief. The basis for the application is that the reason for the dismissal was “making a protected disclosure”. The hearing was to be by telephone on 20 August 2021 starting at 10:00.[3]Neither the claimant nor the respondent attended the telephone hearing. Upon considering the documents within the Tribunal file, it does not appear that it is likely that on determining the complaint that the Tribunal will find that the reason (or if more than one the principal reason) for the dismissal is that the claimant made a protected disclosure.[4]In the circumstances, the claimant’s application for interim relief is refused.
