JUDGMENT
The claimant’s claim for discrimination arising from disability is hereby dismissed upon the withdrawal by the claimant of his claim and consequent upon his failed application to the Tribunal that he had a disability within the meaning of section 6 Equality Act 2010.REASONS
[1]The sole purpose of the preliminary hearing was to consider whether or not the claimant had a disability.[2]The claimant gave evidence and at the end of his evidence, Mr Wiltshire made an application for time to take instructions.[3]After the Tribunal had allowed 20 minutes for those instructions to be taken, Mr Wiltshire returned to the Tribunal and indicated that the claimant wished Case No: 1803669/2021(V) to withdraw his claim for discrimination arising from disability and his application relating to whether or not he had a disability, both of which were dismissed.
