JUDGMENT

The Claimant presented a claim for unpaid wages, unpaid holiday pay and breach of contract on the 21st July 2022. A Rule 21 Judgment was issued on the 1st November 2022 when no Response was received. The Rule 21 Judgment was set aside when a late Response was accepted on the 9th February 2023. A Notice of Hearing for today’ date, the 20th April 2023, was sent to the Parties on the 16th January 2023. The Respondent did not attend the Hearing. It has not engaged with the Claimant or the Tribunal since January and failed to respond to contact made today.[1]The Claimant’s claim for unauthorised deductions from wages is well founded. The Respondent is ordered to pay the Claimant:(i) The net sum of £625 for unpaid wages, and(ii) The gross sum of £312 in respect to accrued but unpaid holiday pay.[2]The Respondent is in breach of contract by failing to pay the Claimant agreed expenses. The Respondent is ordered to pay the Claimant the sum of £100. 10.2 Judgment - rule 61 February Case No: 1803623/2022
