Employment Judge ShulmanIn person for claimantMrs L Tomes (employee (instructed by the Respondent)) for respondentDate 10 September 2019

JUDGMENT

[1]The proper title of the Respondent is Park Homes (UK) Limited.[2]The claim of the Claimant is dismissed by consent.

REASONS

[1]Initially the Respondent made an application for an adjournment because of the unavailability of a witness and this was refused for reasons recorded on file.[2]Mrs Tomes came instead of the Respondent witness as did the Claimant.[3]The Claimant was claiming holiday pay, which included carry over. The Tribunal explained that in the absence of a contract she was not entitled to carry over the holiday or holiday pay. Case No: 1803623/2019[4]The Claimant therefore explained that, excluding carry over, she had had seven days holiday outstanding in the sum of £689.64. The Claimant accepted that she had been paid this sum. She had no further claims to make.[5]In the circumstances I dismissed the Claimant’s claim by consent of the parties.
