The claim is struck out.REASONS
[1]The Claimant failed to attend a Preliminary Hearing for case management on 9 October 2023. He had not notified the Tribunal or the Respondent in advance about any difficulty in attending. He was ordered to write to the Tribunal within 14 days to explain his failure to attend and provide any relevant supporting evidence. He was warned that if he did not respond the Tribunal might consider striking out his claim on the basis that it was not being actively pursued. The Claimant was also ordered to provide further information about his claim and a Schedule of Loss. He has not complied with any of these Orders.[2]By a letter dated 15 November 2023 the Tribunal gave the Claimant an opportunity to make representations, or to request a Hearing at which he could make them, as to why the claim should not be struck out because it has not been actively pursued. The Claimant has failed to respond to that letter.[3]The claim is therefore struck out on the ground that it is not being actively pursued.[4]The Hearing fixed for 23,24 and 25 April 2024 will not take place.
