[1]The complaint of automatically unfair dismissal (section 100(d) Employment Rights Act 1996) is struck out on the ground that it has no reasonable prospects of success.[2]The complaint of an unlawful deduction of wages relating to an alleged failure to pay the claimant the correct rate of pay is withdrawn and is dismissed. REASONS

[1]The claimant was ordered to pay a deposit of £50 following a preliminary hearing held on 12 November 2021. The Order was sent to the claimant on 25 November 2021. The claimant has failed to pay this deposit. The complaint of a failure to pay holiday pay accrued but outstanding on termination is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.
