JUDGMENT

The complaint of unfair dismissal is struck out.

REASONS

[1]By a Deposit Order sent to the parties on 12 September 2023 the Tribunal ordered the claimant to pay a deposit to pursue his complaint of unfair dismissal because it had little reasonable prospect of success.[2]The claimant has failed to pay the deposit by the due date. The complaint of unfair dismissal is therefore struck out.[1]By a letter dated 27 October the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:  the claim for a redundancy payment has no reasonable prospect of success for the reasons set out at paragraphs 2 to 8 and 28 of Employment Judge Jones’ case management orders dated 11 September 2023;  the claimant has not complied with paragraphs 29 and 30 of Judge Jones’ case management orders, requiring him to provide a statement of loss and identify the specific documents required in relation to his claim for unauthorised deductions of wages; and  the claim has not been actively pursued.[2]The claimant has failed to make representations in writing regarding why his claim should not be struck out or requested a hearing to consider this issue. The claim is therefore struck out.[3]The hearing fixed for 19 December 2023 & 20 December 2023 will not take place.
