JUDGMENT
[1]The claim of direct race discrimination arising out of an allegation of being paid less than Mr John George is struck out following non-payment of the deposit that was ordered to be paid by 29th September 2021.[2]The 2 claims of harassment and also that of direct race discrimination arising out of an allegation of being disciplined for allegations of aggressive/inappropriate behaviour, are all dismissed upon them having been withdrawn on the morning of Day 2 of the hearing.[3]The deposits totalling £900.00 which had been paid as a condition of those 3 allegations proceedings, will therefore be refunded to the Claimant pursuant to rule 39 (5) of the Employment Tribunals Rules of Procedure 2013.[4]The claim of victimisation, apart from that which relates to post-employment victimisation, is also dismissed upon it having been withdrawn on the morning of Day 2 of the hearing.[5]Upon the Claimant, on the morning of Day 4 of the hearing, having undertaken to make a contribution of £2,500.00 towards the Respondent’s costs payable in 5 equal monthly instalments commencing on 3rd May 2022, the remaining claims of constructive unfair dismissal and of post-employment victimisation are also dismissed upon withdrawal.
