JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the gross sum of £743.[2]The hearing listed on 15 August 2019 is cancelled. Employment Judge Maidment _____________________________ Date: 24 July 2019 Case No: 1803077/2019 EMPLOYMENT TRIBUNALS Claimant: Mrs M Nowasielska Respondent: Karpaty Bakery Doncaster Ltd

REASONS

There is no reasonable prospect of the original decision being varied or revoked, because at the time the Judgment was issued no response had been received from the Respondent. If any monies have already been paid to the Claimant in respect of the amounts ordered by the Tribunal then the effect of the Tribunal’s Judgment is not to compel the Respondent to pay over the same monies twice. However, the Respondent’s application attached 2 letters giving the appearance of letters sent by the Tribunal accepting a response and recording the terms of a settlement between the parties. Neither letters are genuine correspondence emanating from the Tribunal. No response has been received.
