Miss E Youel and Mr L Lewis v Ms Lyndsey Marshall: 1803018/2019
JUDGMENT
[1]Permission is given to add Mr Leon Lewis as a second claimant.[2]The first claimant, Miss Youel has suffered an unauthorised deduction from her wages in the amount of £495 and the respondent must make payment of that amount to Miss Youel forthwith.[3]The second claimant, Mr L Lewis, has also suffered an unauthorised deductions from wages in the amount of £495 and the respondent must forthwith make that payment to him. [1]The address for service of the respondent is the last known address and on the evidence before me I am satisfied that good service has been effected.[2]Nevertheless the respondent has not participated in these proceedings. Crucially she has not presented a response.[3]It is to be noted from text messages which the claimants have produced to me that the respondent accepted that she owed the claimants for the cleaning work they had undertaken for her. In a message of 24 March 2019 the respondent had written: “I totally understand if you want to take this further and I will of course admit to any Tribunal what is owed to you”.[4]In effect neither claimant was paid for any of the work which they undertook for the respondent. They worked as a team and each undertook 55 hours work for which they expected to be paid at £9 per hour.[5]Although ostensibly the claim was presented by the first claimant only, the particulars of claim made various references to the first claimant working as a team with her boyfriend Mr Leon Lewis. The text messages which I have considered also make it plain that Mr Lewis was working alongside Miss Youel and that the admission of liability referred to above applied equally to him. In those circumstances I considered that it was appropriate to allow the claim to be amended so that Mr Lewis became the second claimant.
