The complaint of unfair dismissal is struck out.REASONS
[1]By a letter dated 18 June 2020 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out because it• The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of unfair dismissal is therefore struck out.[2]The claimant’s remaining claim(s) remains listed for hearing on 19 August 2020. Employment Judge Maidment Date: 7 July 2020[1]The claimant’s complaint of accrued but unpaid holiday entitlement as at the date of the termination of his employment succeeds and the respondent is ordered to pay to him the gross sum of £1446.65 less statutory deductions.[2]Pursuant to section 38 of the Employment Act 2002, the respondent is ordered to pay to the claimant the sum of £1190.28 (2 weeks’ pay) in respect of its failure to provide to him a statement of written particulars of employment.[3]The claimant’s claims of unauthorised deductions from wages in respect of October and November 2019 and a subsequent period spent on furlough, fail and are dismissed.
