JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21 The claim was issued in the Leeds Employment Tribunals on 21 June 2022. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim in accordance with rule 21 of the Rules of Procedure.[1]The Tribunal declares that the respondent has made an unauthorised deduction from the claimant's wages in relation to:a. wages for January 2022 and February 2022, and is ordered to pay the claimant the gross sum of £294.00; andb. 16 days wages for March 2022 and is ordered to pay the claimant the gross sum of £1,230.27; andc. 5 days accrued holiday and is ordered to pay the claimant the gross sum of £384.46.[2]The Tribunal declares that the respondent dismissed the claimant in breach of contract, in relation to unpaid pension contributions. The respondent is ordered to pay damages to the claimant in the gross sum of £831.00.[3]The hearing listed on 14 September 2022 is cancelled.
