JUDGMENT

The claim unfair Dismissal is struck out.

REASONS

[1]The claimant was ordered to pay a deposit of £50.00 following a preliminary hearing held on 7 October 2022. The Order was sent to the claimant on 11 October 2022. The claimant has failed to pay this deposit. The complaint of unfair dismissal is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013. Employment Judge Lancaster Date: 20th December 2022 Case Number: 1802972/2022 EMPLOYMENT TRIBUNALS Claimant: Mr A Collings Respondent: SRCL Limited Heard at: Leeds by telephone On: 5 January 2023 Before: Employment Judge Shepherd Appearances: For the claimant: No attendance for the respondent: Ms Hodgkins, solicitor[1]On 20 December 2022 the Tribunal wrote to the claimant indicating that Employment Judge Shepherd was considering striking out the claim because he had not complied with the orders of the Tribunal dated 7 October 2022. The claimant was given the opportunity to object to this proposal or request a hearing by 27 December 2022.[2]The claimant has not provided any representations or Made request for a hearing and has not attended this hearing. I therefore conclude that he has not complied with the orders of the Tribunal dated 7 October 2022 and he is not actively pursuing this claim.
