The complaint of unfair dismissal is struck out.REASONS
[1]By letter dated 21 May 2020 the Tribunal gave the claimant opportunity to make representations or to request a hearing as to why the complaints of unfair dismissal should not be struck out because the claimant was not entitled to bring a complaint of unfair dismissal as she was not employed for two years or more.[2]The claimant has not made representations in writing and she confirmed at a Preliminary Hearing on 22 July 2020 that she did not have the continuous employment as required to bring a complaint of unfair dismissal pursuant to section 108 of the Employment Rights Act 1996 and the complaint of unfair dismissal is therefore struck out. The claimant’s remaining claims will proceed to a final hearing.
