JUDGMENT

[1]The claimant was an employee of the first respondent at the time that it became insolvent.[2]A week’s pay for the purposes of the Employment Rights Act 1996 (ERA 1996) is £346.15.[3]The first respondent’s annual leave year ran from 1st June.[4]The claimant’s claim for payments from the second respondent under section 182 of the ERA 1996 is well founded.[5]The claimant is entitled to a redundancy payment and for the purposes of s.170(1)(a) ERA 1996 the Tribunal declares that the first respondent is liable to make a redundancy payment to the claimant.[6]The parties shall notify the Tribunal by 14 September 2023 if a further hearing is required in order for the Tribunal to determine any question as to the amount of the sum payable in accordance with s.168 ERA 1996 (in respect of redundancy payment) or s.182 ERA 1996 (in respect of other 10.2 Judgment - rule 61 February Case No: 1802413/2023 payments owed).
