JUDGMENT
[1]The respondent is ordered to pay the claimant the sum of £157 representing the difference between the sum paid to the claimant by the respondent as a redundancy payment and the sum due to the claimant pursuant to section 162 of the Employment Rights Act 1996.[2]The respondent is ordered to pay to the claimant a compensatory award of £2,440.[3]The respondent is ordered to pay to the claimant the sum of £628 as damages for breach of contract (notice pay).[4]The Tribunal having made an award to the claimant in respect of proceedings falling within schedule 5 of the Employment Act 2002 and when proceedings were commenced the respondent was in breach of its duty under section 1(1) of the Employment Rights Act 1996 the claimant is awarded the sum of £626.40.[5]The Employment Protection (Recoupment of Benefits) Regulations 1996 do not apply.
