JUDGMENT
[1]There was a Transfer between Riley Dunn and Wilson Limited to the respondent within the meaning of the Transfer of Undertakings (Protection of Employment) Regulations 2006. (TUPE) on or about 21 January 2019.[2]The first and second claimants were not assigned to the economic entity/organised group of resources that transferred to the respondent immediately before the transfer.[3]In those circumstances, the claims against the respondent are dismissed.[4]The respondent’s application for costs against the claimants is refused.
