JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made unauthorised deductions from the claimant's wages contrary to section 13 of the Employment Rights Act 1996 and is ordered to pay to the claimant the amount of the unauthorised deductions in the sum of £2,580.00 gross (representing unpaid holiday pay of £1,260.00 and statutory sick pay of £1,320.00).[2]The claimant’s complaint of breach of contract is well-founded and the respondent is ordered to pay to the claimant damages for breach of contract in the sum of £1,260.00 (representing his entitlement to three weeks’ notice of termination of employment).[3]The claimant is entitled to be paid by the respondent a redundancy payment under the Employment Rights Act 1996 in the sum of £1,890.00 (4.5 weeks’ pay at £420.00 per week).[4]The hearing on 3 August 2019 is vacated.
