JUDGMENT

[1]The complaint that the Claimant has not been paid in accordance with the National Minimum Wage Act is well founded and the Respondents are liable to pay the Claimant the sum of £2,076.20 less such tax and National Insurance as may be payable.[2]The complaint that the Respondents have failed to pay accrued holiday pay is well founded and the Respondents are liable to pay to the Claimant the sum of £50.95 less such tax and National Insurance as may be payable.[3]The Respondents shall pay the Claimant a further two weeks pay in the total sum of £576.00 for failing to provide the Claimant with a written statement of her terms and conditions of employment pursuant to s38 Employment Act 2002.[4]The Respondents shall refund to the Claimant the Tribunal fees paid by her. It is noted that these are in the sum of £1,200. The Administration are, however asked to review these fees. This would appear to have been a Band A claim that would attract a full fee of £390.00.
