Ms S A Accilen v Redundancy Payments Service: 1801513/2023

EMPLOYMENT TRIBUNALS
Case No 1801513/2023
Ms S A AccilenClaimantRedundancy Payments ServiceRespondent
Employment Judge RogersonDate 31 May 2023

JUDGMENT

The complaint of a failure to pay wages, holiday pay and redundancy pay are struck out.

REASONS

[1]By a letter dated 4 April 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaints of a failure to pay redundancy pay, wages and holiday pay should not be struck out because  Under Section 155 of the Employment Rights Act you were employed for less than two years and therefore do not have the entitlement to bring a claim for redundancy payment  the complaints made against the Redundancy Payments Service had no reasonable prospects of success for the reasons set out in the tribunal’s letter dated 30 May 2023[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaints are therefore struck out.
