Mr R Kenyon v The Secretary of State for Health and Social Care: 1801496/2020
JUDGMENT
[1]The name of the Respondent is amended to The Secretary of State for Health and Social Security.[2]The claims are dismissed upon withdrawal.REASONS
After clarification of his complaints the Claimant accepts that the Employment Tribunal has no jurisdiction in law to hear a breach of contract claim from an existing employee; that as he has not to date been subject to any actual underpayment of salary there can be no claim for unauthorised deductions from wages, and; that the Tribunal cannot make any declaration in respect of future rates of pay nor generally in respect of alleged failure to follow due process in the past. In these circumstances there is presently no subsisting complaint before the Tribunal which it has the power to deal with.
