JUDGMENT
The Claimant’s claim of unfair dismissal is hereby struck out for his failure to actively pursue it and to comply with the Tribunal’s directions.REASONS
The Claimant has failed to comply with the Tribunal’s directions to serve his schedule of loss and disclose relevant documents to the Respondent. These have been requested by the Respondent which had provided to him its own disclosure of documentation but without any response from the Claimant. The Claimant replied to the Tribunal’s strike out warning dated 20 November 2017 referring to a lack of familiarity with the Tribunal process, his other commitments and attempts to replace his lost income and an element of stress caused by his situation. He did not, however, suggest if and how he might comply with the Tribunal’s directions. As a result, the final hearing of this complaint was converted into today’s Preliminary Hearing and the Claimant was given notice that this was to consider whether his claims ought to be struck out. The Claimant has not attended today or notified anyone of any likely non-attendance or difficulty in attending. It has been explained on behalf of the Respondent that the Claimant in the meantime has taken no steps to comply with the Tribunal’s directions or to communicate at all. In the circumstances, the Tribunal can come to no other conclusion but that the Claimant’s default and failure to engage with 10.2 Judgment - rule 61 March 2017 Case No: 1801442/2017 the proceedings should lead to the dismissal of his claim.
