The claim is struck out.REASONS
[1]The Claimant failed to comply with the Order of the Tribunal dated 16 August 2017 requiring him to provide the Respondent with his witness statements by 25 October 2017.[2]The Claimant failed to provide any objections to the Respondent’s application for a strike out made by email dated 30 October 2017(copied to the Claimant)[3]The Claimant failed to respond to a strike out warning sent to the Claimant by the Tribunal on 13 November 2017.[4]The Claimant has given no reason for his failure to comply with the Tribunal’s Order. His failure to provide his witness evidence while having the Respondent’s witness evidence unfairly prejudices the Respondent’s ability to prepare and present its case.[5]The Tribunal therefore strikes out the claim under Rule 37 of its Rules of Procedure because the Claimant has failed to comply with the Tribunal’s Order and is not actively pursuing his claim.
