JUDGMENT

[1]The Claimant was continuously employed by the Respondent from 13th October 2017 until 13th December 2017.[2]The Respondent has made an unauthorised deduction from the Claimant’s wages by only paying £100.00 of the £1237.50 due for 165 hours worked at Yeanons Café, Ossett between 31st October 2017 and 6th December 2017.[3]The Respondent is ordered to pay to the Claimant compensation in the gross sum of £1137.50.[4]The Respondent is further ordered, under section 24 (2) of the Employment Rights Act 1996, to pay to the Claimant the additional sum of £104.00 as compensation for the financial loss sustained by her as a result of incurring overdraft charges by reason of the non-payment of wages.[5]The award is increased by the minimum amount of 2 weeks’ pay, under section 38 of the Employment Act 2002, by reason of the employer’s failure to provide a written statement of employment particulars under Part 1 of the Employment Rights Act 1996 and the Respondent is ordered to pay to the Claimant the further sum of £450.00.[6]The total sum which the Respondent is ordered to pay to the Claimant is £1691.50
