JUDGMENT
[1]The claimant’s complaints of unfair dismissal and breach of contract are well founded and succeed.[2]The respondent shall pay the following sums in gross damages (salary and pension) in respect of its failure to provide three months’ notice: £13, 118.[3]I make no Basic Award (the claimant having received a statutory redundancy payment from the Insolvency Service).[4]The respondent shall pay to the claimant a Compensatory Award of £18, 875.[5]The prescribed period is 3 March 2021 to 4 August 2021. The Prescribed Element is £18375. The amount by which the compensatory Award exceeds the prescribed element is £500 (loss of statutory rights).[6]The recoupment regulations apply to this compensatory award.
