[1]The part of the response relating to the claim of unfair dismissal is struck out.[2]The Claimant was unfairly dismissed.REASONS
[1]The respondent was ordered to pay a deposit of £1000.00 following a preliminary hearing held on 13th August 2019. The order was sent to the respondent on 14th August 2019. The respondent has failed to pay this deposit. The respondent’s part of the response relating to the claim of unfair dismissal is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013 and under rule 21(2) a determination on that part of the claim is made accordingly.[2]The consolidated hearing fixed for 7th January 2010 will still take place, but in respect of the unfair dismissal claim will be a remedy hearing only.
